High court quashes trail proceedings and FIR

 NURMAHAL: The Punjab and Haryana High Court has quashed trail proceedings and FIR on the basis of a compromise reached between two parties.

Justice Rajbir Sehrawat said in his order that in view of the reports of Judicial Magistrate 1st Class, Phillaur dated 03.04.2019, made in pursuance of the orders dated 27.02.2019 and 22.02.2019, passed by this Court, the Court feels that no useful purpose would be served by keeping the proceedings alive. It will be in the interest of justice if the settlement reached between the parties is accepted. Accordingly FIR No.61 dated 10.08.2016 registered under Sections 323, 325, 452, 148 and 149 of IPC and its cross version in case DDR No.003 dated 08.09.2016 registered under Sections 323, 341, 34 of IPC, at Police Station Nurmahal,  Jalandhar Rural and all consequential proceedings arising there from, are quashed on the basis of compromise arrived at .

The court order said that the parties were directed to appear before the trial Court/Illaqa Magistrate, for getting their statements recorded; as to the genuineness of the compromise. In compliance thereof, reports of Judicial Magistrate 1st Class, Phillaur, dated 03.04.2019 have been received, wherein, it has been noticed that the compromise arrived at between the parties is genuine, voluntarily, without any pressure or coercion.
